TARPUM BAY COMMONAGE

An Act to confirm the exchange of certain lands situate in the vicinity of Tarpum Bay in the Island of Eleuthera.

1. This Act may be cited as the Tarpum Bay Commonage Act.

Short title.

2. (1) The exchange of lands by the Tarpum Bay Commoners with the Island Estates, Limited, as contained in two indentures both dated the 28th day of October, A.D., 1940, and made between Island Estates, Limited, and the Commoners of Tarpum Bay, Eleuthera, and now lodged for record in the Registry of Records of the Colony is hereby approved, ratified and confirmed.

Exchange of certain lands confirmed.

(2) The land conveyed by the Commoners of Tarpum Bay to Island Estates, Limited, by the said indenture of the 28th day of October, A.D., 1940, is hereby vested in Island Estates, Limited, and their assigns in fee simple free from all liens, incumbrances, estates and claims thereto whether present or future.

Certain lands vested in Island Estates, Limited.

(3) The land conveyed by Island Estates, Limited, to the Commoners of Tarpum Bay by the said indenture of the 28th day of October, A.D., 1940, is hereby vested in the Commoners of Tarpum Bay in fee simple free from all liens, incumbrances estates and claims thereto whether present or future, and the Commoners of Tarpum Bay shall hold the same as commonage land and subject to the provisions of the Commonage Act.

3. Nothing in this Act shall prejudice or affect the rights of His Majesty the King, his Heirs and Successors or of any other body politic or corporate or of any other person or persons except such as are mentioned in this Act and those claiming by, from, through or under them.
