IMPERIAL LANDS OF THE MINISTER OF TRANSPORT

An Act to empower the minister of transport of the United Kingdom of Great Britain and Northern Ireland to acquire, hold and dispose of lands and interests in land in the colony and to vest in the minister of transport certain lands and interests in land in the colony.

1. This Act may be cited as the Imperial Lands of the Minister of Transport Act.

Short title.

2. In this Act, unless the context otherwise requires, the following expressions have the meanings hereby assigned to them respectively, that is to say:

Interpretation.

"the Board of Trade" includes the Board of Trade of the United Kingdom of Great Britain and Northern Ireland and the Lords of the Committee for the time being of the Privy Council appointed for the consideration of matters relating to trade and foreign plantations and their successors in office and any person or persons acting on behalf of the Lords Commissioners of the Privy Council for Trade or the Board of Trade or such Lords of such Committee as aforesaid;

"land" includes land freehold or leasehold or of whatever tenure and tenements and hereditaments corporeal or incorporeal and houses and other buildings;

"the Minister of Transport" means the Minister of Transport of the United Kingdom of Great Britain and Northern Ireland constituted under the style and title by the Minister of Aviation Order, 1959, made under the Imperial Act 9 and 10 George VI chapter 31 entitled The Ministers of the Crown (Transfer of Functions) Act, 1946 ,and the "Ministry of Transport" has a corresponding meaning;

"the Minister of Shipping" means the Minister constituted under that style and title by the Ministers of the Crown (Minister of Shipping) Order, 1939, made under the Imperial Act 2 and 3 George VI, c.77 entitled The Ministers of the Crown (Emergency Appointment) Act, 1939.

3. The Minister of Transport shall from and after the 21st day of October, 1959, have power to acquire hold and dispose of land and interests in land in the Colony and all lands and interests in lands in the Colony held by the Minister of Transport and Civil Aviation or hereafter purchased, taken or held by the Minister of Transport shall vest in the Minister of Transport for the time being and his successors in office for the purposes of the Ministry of Transport for all the estate or interest conveyed granted or demised.

The Minister of Transport to have power to acquire hold and dispose of land.

4. Notwithstanding the provisions of any Act all lands and interests in land described in the Schedule to this Act are hereby vested in the Minister of Transport for the time being and his successors in office for the purposes of the Ministry of Transport for all such estates and interests for which they were previously held by the Minister of Transport and Civil Aviation.

All lands described in the Schedule to this Act transferred to Minister of Transport.

5. Any deed, contract, agreement or other instrument to be executed by or on behalf of the Minister of Transport shall be valid if authenticated by the Minister of transport or by any person authorised in writing by the Minister in that behalf.

Execution of deeds.

SCHEDULE (Section 4)

1. All those four (4) Islets, Cays or Rocks within the group of the Bahamas on which lighthouses have been erected and are now standing, and described in a Crown Grant dated the 7th day of March, 1884, and of record in the Registry of Records at Nassau in the Island of New Providence, Bahamas, in Book I. 8 at page 163 namely:

Bird Rock.

(a)
All that Cay or Rock situate near the northwest point of Crooked Island called "Bird Rock"; and

Cay Lobos.

(b)
All the Islet or Cay Called "Cay Lobos" situate on the southern edge of the Great Bahama Bank and northern edge of the old Bahama Channel; and

Great Isaac.

(c)
All that Cay or Rock situate near the northwestern extremity of the said Great Bahama Bank and Called the "Great Isaac" save such part thereof as has been released for use as a Long Range Proving Ground; and

Double Headed Shot Cay (Cay Sal).

(d)
All that Cay or Rock situate on the western edge of the Cay Sal Bank and called "Double Headed Shot Cay".

McKenzie Point South West Inagua.

2. All that four ( 4) acres of land at the south-west of McKenzie Point in the Island of Inagua, Bahamas, and bounded on the north-west by a reservation for a public road separating it from land granted to G. B. Allen and on the other sides by a reservation for a public road along the shore as shown on a plan attached to a Crown Grand dated the 7th day of March, 1884, and of record in the Registry of Records at Nassau in the Islands of New Providence, Bahamas, in Book I. 8 at page 166.

South of Mathew Town Inagua.

3. All that nine (9) acres of land in the vicinity and south of Mathew Town in the Island of Inagua, Bahamas, and bounded on the north by a public road and vacant Crown Land and on the east and south by vacant Crown Land and on the west by the sea, excepting therefrom a reservation for public use of a road passing through the allotment as shown on a plan attached to a certain Crown Grant dated the 7th day of March, 1884, and of record in the Registry of Records aforesaid in Book I. 8 at page 166.

Hole in the Wall, Abaco.

4. All that thirty (30) acres of land at Hole in the Wall, Abaco, Bahamas, bounded on the west by a reservation for a public road separating the allotment from lands granted to Joseph S. Johnson and on the north by vacant Crown Land and on the other sides by the sea as shown on a plan attached to a certain Crown Grant dated the 7th day of March, 1884, and of record in the Registry of Records aforesaid in Book I. 8 at page 167.

Castle Island.

5. All that twenty (20) acres of land situate on Castle Island, Bahamas, near the south-west point of Acklins Island, Bahamas, on which the lighthouse now stands, bounded northwardly and eastwardly by a reservation for a public road separating it from land granted to Bulmer Howell and on the other sides by the sea as shown on a plan attached to a certain Crown Grant dated the 7th day of March, 1884, and of record in the Registry of Records aforesaid in Book I. 8 at page 164.

Great Stirrup Cay.

6. All that four (4) acres of land situate on Great Stirrup Cay, Berry Islands, Bahamas, on which the lighthouse now stands bounded on the east by a reservation for a public road separating the allotment from land granted to H. W. Whitfield, on the south by a reservation for a public road and land granted to Mary Sistare, on the north by a reservation for a public road along the shore and on the west by a reservation for a public road and Crown Land as shown on a plan attached to a certain Crown Grant dated the 7th day of March, 1884, and of record in the Registry of Records aforesaid in Book I. 8 at page 162.

Watlings Island.

7. All that thirty-two (32) acres of land situate on Watlings Island, Bahamas being part of a tract containing Sixty (60) acres originally granted by the Crown by Letters Patent dated the 17th day of October, 1810, to one John Weir and bounded on the north and south by parts of the original tract belonging to one Shylock Strachan on the west by part of the Great Lake called "Dixon Bridge Pond" and on the north-east and south-east by lands formerly in the occupation of Zachariah Fisher and others as shown on a plan attached to a certain Indenture dated the 30th day of January, 1885, and of record in the Registry of Records aforesaid in Book Q. 9 at pages 445 to 451 and lettered "A".

Elbow Cay Abaco.

8. All that portion of a twenty (20) acre tract of land on which the lighthouse now stands at Little Guana Cay, Bahamas, being part of an eighty (80) acre tract granted to one George Smith, as appears in Grant Book numbered 65 in the Crown Lands Office in the Island of New Providence, Bahamas, and which was on the 27th day of March, 1847, transferred to one Thomas Russell as shown on a plan numbered 21-a on deposit in the Crown Lands Office aforesaid.

Potters Cay (East End).

9. All that piece parcel or tract of land situate on the East End of Potters Cay, New Providence, aforesaid containing an area of one (1) acre and six and one-half (6½) perches which was vested in the Board of Trade by an Act of the Legislature of the Bahamas entitled The Ordnance Lands Act, 1904, as shown on the War Department Plan numbered ten (10) of record in the Crown Lands office aforesaid.

10.
Morro Castle.

All that piece parcel or tract of land situate in the Western District of the Island of New Providence aforesaid and known as "Mono Castle" and bounded on the north by the Fort Charlotte Grounds on the west by land formerly the property of one Hazel B. Colville on the east by a public road and on the south by Deans Lane as shown on a plan attached to an Indenture dated the 22nd day of July, 1940, and of record in the Registry of Records aforesaid in Book S. 15 at pages 361 to 362.

11.
Board of Trade Building, Union Street, Nassau.

All that piece parcel or tract of land situate in the City of Nassau in the Island of New Providence aforesaid and bounded on the north by the Harbour of Nassau and extending thereon ninety-five (95) feet on the west by land conveyed to the Board of Trade and extending thereon one hundred and four (104) feet and eight (8) inches on the east by Union Street and extending thereon one hundred and four (104) feet and three (3) inches and on the south by lands formerly the property of George William Oliver and extending thereon ninety-eight (98) feet and four (4) inches as shown on a plan attached to an Indenture dated the 15th day of July, 1920, and of record in the Registry of Records aforesaid in Book I. 11 at pages 476 to 479.

12.
Board of Trade Building, Bay Street.

All that piece parcel or tract of land situate in the City of Nassau in the Island of New Providence aforesaid and fronting to the south on Bay Street and bounded on the west by land formerly the property of the late Thomas William Williams on the north by the Harbour of Nassau and on the east by land formerly the property of the late Edwin S. Hall and having the boundaries and dimensions set out and delineated on a plan attached to a certain Indenture of record in the Registry of Records aforesaid in Book P. 10 at pages 427 to 440:

Save and except the westerly portion thereof now the property of Desmond Investments Limited and having the boundaries and dimensions set out and delineated on a plan attached to a certain Indenture dated the 8th day of June, 1960, and of record in the Registry of Records in the Island of New Providence, Bahama Islands in Book 370 at pages 506 to 515 inclusive.

13. All that piece parcel or tract of land situate in the Western District of the said Island of New Providence being Lot numbered sixteen (16) in Block numbered eighteen (18) of the revised plan of the said Block numbered eighteen (18) of the Westward Villas subdivision (second addition) as shown on a plan attached to a certain Indenture dated the 5th day of Octover 1959 and of record in the Registry of Records aforesaid in Book Vol. 219 at pages 347 to 354 inclusive.
