CHAPTER 41

THE PRIME MINISTER'S PERSONAL STAFF

An Act to make provision for a personal staff establishment to the office of Prime Minister and for the payment to members of that staff of salaries and allowances provided by parliament.

1. This Act may be cited as The Prime Minister's Personal Staff Act.

Short title.

2. (1) There shall be a personal staff establishment to the Office of Prime Minister consisting of the several offices and positions specified in the Schedule.

(2) Subject to section 4, power to make appointments to the offices and positions specified in the Schedule and to remove and to exercise disciplinary control over persons holding or acting in any such office or position is hereby vested in the Prime Minister.

3. (1) Sections 5 to 8, sections 15 to 17 and section 19 of the Public Service Act, shall, subject to the provisions of subsection (2), apply to all persons appointed to the offices or positions specified in the Schedule as if such persons were public officers.

(2) The Prime Minister shall exercise in relation to any holder of those offices or positions specified in the Schedule all such or like powers as are vested in the competent authority contemplated by those provisions of the Public Service Act mentioned in subsection (1).

4. Notwithstanding anything to the contrary in section 3, in the case of any public officer who has been selected for an appointment to the personal staff establishment from a list submitted by the Public Service Commission-

(a)
the exercise by the Prime Minister of the powers mentioned in section 3(2) shall apply only to the tenure by that officer of his appointment on the personal staff establishment;
(b)
an officer so appointed shall not during continuance on the personal staff of the Prime Minister perform the functions of any public office; and
(c)
an officer so appointed may at any time be released by the Prime Minister, if the Governor-General acting on the advice of the Public Service Commission so recommends, to assume or resume the functions of a public officer and he shall thereupon vacate his office on the personal staff establishment.

5. (1) Save as mentioned in sections 3 and 4 and in subsection (2) of this section, the several offices and positions specified in the Schedule shall not be regarded as public offices for the purposes of the Constitution.

(2) Service in any office or position to which subsection (1) applies shall be deemed public service for the purposes of the Pensions Act unless it is otherwise provided in any contract pursuant to which the appointment to that office or position was effected.

6. Subject to section 3, the salaries and allowances payable to the holders of any office or position mentioned in the Schedule shall be paid out of such sums as Parliament may from time to time appropriate for that purpose.

7. The Governor-General may by order amend the Schedule.
