CYCLE

An Act to provide for the registration and use of cycles.

1. This Act may be cited as the Cycle Act.

Short title.

2. In this Act, unless the context otherwise requires-

Interpretation.

"Controller" has the same meaning as is given to that word under section 2(1) of the Road Traffic Act;

"cycle" includes every description of bicycle, tricycle and velocipede;

"purchase" includes every transfer by means of sale, gift, bequest or otherwise.

3. Every owner of a cycle kept for use, except as in this Act otherwise provided, shall register or cause the same to be registered in his name with the Controller (who shall keep a register of cycles) in the month of December in each year in accordance with the provisions of this Act, and such registration shall continue in force from the day of such registration until and throughout the last day of December next succeeding, and shall take out a licence therefor. Every such licence shall be issued by the Controller and shall expire on the thirty-first day of December next following the issue thereof.

4. Every owner of a cycle purchased in any year prior to the month of December in that year shall have his cycle registered within fourteen days after such purchase, and such registration shall continue in force from the day of such registration until and throughout the last day of December next succeeding.

5. Every cycle registered after the commencement of this Act which shall be purchased by any person shall be re-registered by the purchaser in the name of the purchaser, within fourteen days after such purchase.

Re-registration of cycles.

6. The Controller shall assign a separate number to every cycle registered under this Act, and one plate, on which is the registered number of the cycle, shall be supplied by the Controller to each registered cycle, and this plate with the number clearly exhibited shall be affixed on the cycle.

7. Before registering or re-registering a cycle, the Controller shall require the purchaser to produce to him written evidence of ownership of the cycle.

8. (1) There shall be paid into the Treasury on every registration or re-registration under this Act the sum of one dollar.

(2) In respect of every registration and re-registration on and after the first day of July in each year only one-half of the above sum shall be paid.

(3) Notwithstanding the provisions of subsections (1) and (2) of this section, a consular officer or a consular employee who is-

(a)
not a British subject;
(b)
not engaged in The Bahamas in private occupation for gain; and
(c)
a permanent employee of the State in whose service he or she is, or if not a permanent employee, who was not resident in The Bahamas at the commencement of his or her employment at the consulate,

shall not be required to make any payment in respect of any such registration or re-registration.

9. Any owner of a registered cycle whereof the registered number has been lost or damaged or become illegible may have the same renewed at the place of registration on payment of one dollar.

10. Any person using a cycle without a registered number affixed thereon shall be liable on conviction for an offence against this Act.

11. Any person using a cycle shall on the request of any member of the police force stop such cycle to enable the registration number to be examined, and shall give correct replies to the police to all questions put to him relative to the registration and ownership of such cycle. Any person acting in contravention of this section shall be guilty of an offence against this Act.

12. Any person guilty of an offence against this Act shall on summary conviction be liable to a fine of twenty dollars or to imprisonment for two months or to both such imprisonment and fine.

Penalty.

13. It shall be lawful for any member of the police force to take into custody without warrant any person found in the possession of any unregistered cycle, and to seize and detain such cycle pending further investigation.

14. Any extract from the register of cycles kept by the Controller under this Act, certified by the Controller to be a true extract, shall be received in evidence in all courts.

15. All expenses incurred in carrying out the provisions of this Act shall be paid out of the Consolidated Fund by warrant in the usual manner.

16. The Minister responsible for Road Traffic may make rules-

Rules.

(a)
providing generally for facilitating the identification of cycles and in particular for determining and regulating generally the size, shape and character of the plates to be fixed on a cycle under this Act, and the mode in which they are to be fixed and to be rendered easily distinguishable whether by night or by day, and with respect to the registration of cycles and the entry of particulars including particulars of the ownership of the cycles in the register, and the giving of those particulars and for making any particulars contained in the register available for use by the police, and for making the registration of a cycle void if the rules as to registration are not complied with;
(b)
with respect to the licences to be granted by the Controller under this Act and for the transfer of the licences and in particular with respect to the register to be kept of those licences and transfers;
(c)
with respect to the use of lights to be carried on cycles; and
(d)
with respect to the terms and conditions upon which licences may be granted under this Act.
