CHAPTER 207

POLICE FORCE (MILITARY SERVICE)

An Act to render members of the Police Force liable to military service and to provide for the impressment of transport in the event of danger of invasion or other sufficient emergency.

1. This Act may be cited as the Police Force (Military Service) Act, and shall be read and construed as one with the Police Act.

Short title.

2. Whenever the Governor-General considers that The Bahamas is in imminent danger of invasion or that any other sufficient emergency has arisen, the Governor-General may, if he thinks fit, by Order, order that the Police Force shall become liable to military service, and thereupon every member of the force whether enrolled in the force before or after the commencement of this Act shall immediately become subject to military law and liable to serve in any part of The Bahamas, and shall remain so subject and liable until the Governor-General shall, by Order, otherwise order.

3. So long as an Order under this Act is in force a member of the force shall not, notwithstanding the expiration of the period of his engagement under the Police Act, or any other Act for the time being in force relating to the force, be entitled to be discharged from the force.

Discharge from Police Force.

4. Except as mentioned in this Act, nothing in this Act or in any Order made under this Act shall affect the powers, privileges or duties of any member of the force under the Police Act, or any other law or Act or under the common law.

Saving of power as members of Police Force.

5. (1) When an Order has been made under section 2 of this Act it shall be lawful for any member of the force, not below the rank of sergeant-major, to impress boats, vehicles, animals and any article whatsoever as the circumstances may require.

Impressment, and remuneration therefor.

(2) Whenever the Governor-General considers that in view of the existence of an emergency the circumstances warrant it, he may impress boats, vehicles and animals for such time as may be necessary.

(3) When any action has been taken under subsection (1) or (2) of this section the owners of the property or the person concerned shall receive such remuneration as may be approved by the Governor-General.

6. When an Order has been issued under section 2 of this Act it shall be lawful for the Governor-General to have enrolled in the force during the continuance of such Order a greater number of officers and men than are ordinarily provided for by law and such additional members of the force so enrolled shall in all respects and for all purposes be considered as members of the force and be subjected to all such laws as are members of the force.
