REGISTRAR GENERAL |

1. This Act may be cited as the Registrar General Act. | Short title. |
2. In this Act, "Registrar General",
"Deputy Registrar General" and "Assistant Registrar
General" mean the persons respectively appointed as Registrar General,
Deputy Registrar General and Assistant Registrar General under the provisions
of this Act. | Interpretation. |
3. The Departments of the Registrar General and of the
Registrar of Records shall be controlled and administered as one under the
management of the Registrar General. | Amalgamation of Departments. |
4. The Governor-General, acting in accordance with the
advice of the Judicial and Legal Service Commission, may appoint a Registrar
General who shall hold office during pleasure. No person shall be appointed
Registrar General unless- | Appointment of Registrar General. |
(a) he is a
member of at least five years standing of the English, Irish, Scottish or
Bahamas Bar, or of the Bar of any other country of the Commonwealth to which a member of the Bahamas Bar is
admitted without examination; or |
(b) he has been
enrolled and has practised for at least five years as a solicitor in England,
Ireland or Scotland, or in any other country of the Commonwealth in which a
member of the Bahamas Bar is permitted to practise as a solicitor without
examination. |
5. (1) The Governor-General, acting in accordance with
the advice of the Judicial and Legal Service Commission, may appoint a Deputy
Registrar General and Assistant Registrar General who shall
hold office during pleasure. | Appointment of Deputy Registrar General and Assistant

(2)
The Deputy Registrar General and Assistant
Registrar General shall assist the Registrar General in the discharge of his
duties as Registrar General and may, subject to the directions and instructions
of the Registrar General, during the temporary absence of the Registrar General
from the Registry, lawfully perform all the duties and exercise all the powers
of the Registrar General under this or any other Act. |
(3)
Nothing in this Act shall be deemed to preclude the Deputy Registrar General
and Assistant Registrar General from holding any office in the gift of either
House of Parliament. |
6. (1) All powers, authorities, jurisdictions, rights,
privileges, duties and liabilities by any Act conferred or imposed on the
Registrar of Records whether original or ex officio shall upon the
amalgamation of the registries as provided for in section 3 of this Act be
conferred and imposed on the Registrar General, who shall, for the purposes of
any Act, be deemed to be the Registrar of Records. | Vesting of powers in Registrar General. |
(2) Any reference
in any law or in any agreement, contract, deed or other document to the
Registrar of Records, shall be deemed to refer to, and shall be read and
construed as a reference to the Registrar General. |
7. The Registrar General shall be ex officio a
magistrate for New Providence, and shall be invested with all the powers,
authorities, jurisdictions, rights, privileges, duties and liabilities
conferred or imposed on a magistrate by any Act. | Registrar General ex officio a magistrate. |
8. The Deputy Registrar General
and Assistant Registrar General shall have power to administer oaths and take
solemn declarations or affirmations in all matters required to be taken or made

9. The Governor-General acting in accordance with the
advice of the Public Service Commission may appoint such clerks in the
Registrar General's Department as are provided for by any Act. | Clerks in the Registrar General's Department. |
10. The Deputy Registrar General
and Assistant Registrar General as assistants to the Registrar of Records and
the clerks in the Registrar General's Department shall be subject to the orders
and be under the control of the Registrar General. | Clerks to be under the control of the Registrar

11. A public officer in the Registrar General's
Department, designated for that purpose by the Registrar General by notice in
the Gazette, may administer all oaths and take all affirmations required
to be taken or made by the Registration of Records Act or any Act for the
time being regulating the administration and taking of the same. | Power to administer oaths. |
12. The Minister responsible for the Registry of
Records may make rules for carrying into effect the objects of this Act. | Rules. |
