An Act to
make provision for the payment of an allowance to members of Parliament for the
establishment and maintenance of a Constituency Office and for purposes
connected thereto. | 30 of 1998 |

1. (1) This Act may be cited as the Parliamentarians
(Constituency Office Allowance) Act, 1998. | Short title and commencement. |
(2) This Act is deemed
to have come into force on the 1st day of October, 1997. |
2. (1) There shall be paid to every Member of Parliament
elected to a constituency in New Providence, Grand Bahama and Bimini an annual
allowance specified in Part I of the First Schedule and such allowance shall be
used for the establishment and maintenance of a constituency office and for
purposes specified in Part I of the Second Schedule. | Payment of allowance. |
(2) There shall be
paid to every Member of Parliament elected to a constituency in a Family Island
(other than Grand Bahama and Bimini) an annual allowance specified in Part II
of the
First Scheduleand
such an allowance shall be used for the establishment and maintenance of a constituency
office, for purposes specified in Part II of the Second Schedule and for
carrying out duties in relation to the constituency. |
(3) No Member of
Parliament shall use a constituency office or allow a constituency office to be
used for any public political meeting or fund raising activity for any
political party. |
3. (1) Every Member of Parliament shall keep proper
accounts and retain receipts of payments made for the purposes of this Act and
such accounts shall be audited annually by the Auditor-General. | Accounts and audit. |
(2) Where any
allowance or any portion thereof is used or applied for any purpose other than
those specified in section 2, the Member of Parliament shall be liable to pay
such sums to the Treasurer. |
4. All allowances payable under this Act shall be
charged on and paid out of the Consolidated Fund by equal monthly instalments. | Payment of allowances. |
5. (1) The Prime Minister may by Order subject to
affirmative resolution of the House of Assembly amend the Schedules. | Amendment of Schedules. |
(2) In subsection
(1), the expression "subject to affirmative resolution of the House of
Assembly" in relation to an Order means that any such Order shall not come
into operation until approved by a resolution of the House of Assembly. |
