MARRIAGE OF BRITISH SUBJECTS FACILITIES

An Act to facilitate marriages between British subjects resident in The Bahamas and British subjects resident in the United Kingdom and the Republic of Ireland.

1. This Act may be cited as the Marriage of British Subjects Facilities Act.

Short title.

2. (1) When a marriage is intended to be solemnized or contracted in The Bahamas between a British subject resident in The Bahamas and a British subject resident in the United Kingdom or Republic of Ireland, a certificate for marriage lawfully issued in the United Kingdom or Republic of Ireland, as the case may be, shall, in The Bahamas, have the same effect as a certificate for marriage issued in The Bahamas by a registrar of marriages or marriage officer.

Facilities for marriages between British subjects resident in The Bahamas and British subjects resident in the United Kingdom and the Republic of Ireland.

(2) When a marriage is intended to be solemnized or contracted in the United Kingdom or Republic of Ireland between a British subject resident in the United Kingdom or Republic of Ireland and a British subject resident in The Bahamas, a registrar's certificate of due publication of notice to marry, or a marriage officer's certificate of the due publication of banns, may be issued in The Bahamas in the like manner as if the marriage was to be solemnized or contracted under circumstances requiring the issue of such a certificate, and as if both such British subjects were resident in The Bahamas.

(3) For the purposes of subsection (1) of this section the expression "certificate for marriage lawfully issued" means-

(a)
in the case of England and Wales, a certificate for marriage issued by a superintendent registrar;
(b)
in the case of Scotland, a certificate for marriage issued by a registrar or a certificate of proclamation of banns:
(c)
in the case of Northern Ireland or the Republic of Ireland, a certificate for marriage issued by a registrar.

(4) In this Act the expression "the United Kingdom" means the United Kingdom of Great Britain and Northern Ireland.
