AN ACT TO AMEND THE PROFESSIONAL
ENGINEERS ACT |

Enacted by the Parliament of The Bahamas. |
1.(1) This Act, which amends the
Professional Engineers Act, may be cited as The Professional Engineers
(Amendment) Act, 2006. | Short title and commencement. No. 12 of 2004. |
(2) This Act is deemed to have
come into force on the 25th day of August, 2004. |
2. Section 9 of the principal
Act is amended in the proviso by deleting the word “twelve” and substituting
therefor the words “thirty-six”, and by deleting the words "one year"
and substituting therefor the words “three years”. | Amends section 9 of the principal
Act. |
3. Section 34 of the principal
Act is amended - | Amends section 34 of the principal
Act. |
(a) by renumbering section 34 as
“section 34(1)”; |
(b) in paragraph (a) by deleting the word
“twelve” and substituting therefor the words “twenty-four”; and |
(c) by inserting subsections (2), (3)
and (4) as follows - |
"(2) Notwithstanding any
provision of this Act, the first Professional Engineers Board shall consist of
seven individuals who are eligible to be registered as engineers and who shall
be appointed by the Minister acting on his discretion. |
(3) A member of the Board appointed
under subsection (2) of this section shall hold office until the 25th
day of August, 2006 but shall be eligible thereafter for membership of the
Board. |
(4) The provisions of this Act shall
apply mutatis mutandis to a Board constituted under subsection (2) of this
section, and to any member of the Board as if he were a member appointed under
section 3(2)(c) and (d), save that the Minister shall not be required to act
with the concurrence of any association of engineers.”. |
