AN ACT TO AMEND THE ROAD TRAFFIC
ACT |

1. This Act may be cited as the
Road Traffic (Amendment) Act, 2004. | Short title. |
2. Subsection (1) of section 10
of the Road Traffic Act is amended as follows – | Amendment of section 10 of Ch. 220. |
(a) by the deletion of paragraph
(b)(i) and the substitution therefor of the following – |
"(b) in the case of a public
service vehicle (other than a self-drive vehicle), insures such person, persons
or classes of persons as may he specified in the policy in respect of liability
which may be incurred by him or them in respect of – |
(i) the death of or bodily injury
to any person (including any passenger being carried for hire or reward) caused
by or arising out of the use of the vehicle on a road for an amount, inclusive
of costs and expenses incurred in relation thereto, of not less than two
million five hundred thousand dollars in respect of any one claim by any one
person or thirty million dollars in respect of all claims arising out of one
original cause or event"; |
(b) by the deletion of paragraph (c)
and the substitution therefor of the following – |
"(c) in the case of any motor
vehicle other than a public service vehicle, and in the case of a self-drive
vehicle, insures such person, persons or classes of persons as may be specified
in the policy in respect of liability which may be incurred by him or them in
respect of the death of or bodily injury to any person caused by or arising out
of the use of the vehicle on a road for an amount, inclusive of costs and
expenses incurred in relation thereto, of not less than two million five
hundred thousand dollars in respect of any one claim by any one person or
thirty million dollars in respect of all claims arising out of one original
cause or event: |
Provided that such a policy
shall not be required to cover – |
(i) except in respect of
passengers who are lawfully being carried in a motor vehicle by reason of or in
pursuance of a contract of employment, liability in respect of the death of or
bodily injury to persons being carried in or upon or entering or getting on to
or alighting from the motor vehicle at the time of the occurrence of the event
out of which the claim arises; or |
(ii) any contractual
liability; or |
(iii) except in the case of a self-drive
vehicle, liability in respect of the first forty dollars of any claim by any
person." |
